BigTreeUSA LLC consistently works toward maintaining competitive prices on everything we carry and therefore, BigTreeUSA LLC doesn't offer price matching.

Pricing Errors

All prices on this web site are subject to change without notice. While we make every effort to provide you the most accurate, up-to-date information, it is entirely possible that one or more items on our web site may be incorrectly priced.

In the event a product is listed at an incorrect price due to typographical, photographic, technical error, or error in pricing information received from our suppliers, BigTreeUSA LLC shall have the right to refuse or cancel any orders placed for product listed with an incorrect price.

Open Box Special Pricing

"Open Box Specials" that are featured on our website are a great way to save money on the best-selling FUTONS on the market today. However, due to the extreme low price of these offers, we CANNOT accept returns. NO EXCEPTIONS. However, the 30-day WARRANTY does apply to any manufacturing defects on the frame. Please use the form on the Contact Us page of our website for any questions or problems. Please your FULL NAME, ADDRESS, INVOICE NUMBER, PHONE NUMBER and EMAIL ADDRESS where we can contact you.

"Open Box" simply means that the item has been removed from its original packaging or that the futon price has been reduced to make room for other merchandise.

Our "Open Box" products are in excellent working condition with no or only minor cosmetic wear.

Right To Cancel Order

BigTreeUSA LLC reserves the right to cancel any order for any reason including but not limited to a pricing error.

We reserve the right, at our sole discretion, to change, modify, or otherwise alter these terms and conditions at any time without notification. Such modifications shall become effective immediately or even retroactively upon the posting thereof.

By agreeing to our terms of use, you agree that any claims, disputes or other controversies related any which way to this transaction shall be brought to arbitration.

Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial [or other] Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

Warranty

BigTreeUSA LLC warranty obligations are limited to the terms set forth below:

The BigTreeUSA LLC warranty covers items that are listed as being under the BigTreeUSA warranty. Accessory parts like trampoline material, slip pads, and use damage to wood parts are not covered by our warranty. Abuse of this product in any form will be determined by BigTreeUSA LLC .

All items sold as new will include a 30-day warranty .

Warranty service will also apply to frame(s) purchased under our OPEN BOX condition. The length of the warranty period on our open box items may vary depending on the item. If not specified, OPEN BOX frames carry a 30-day year warranty.

WARRANTY RETURNS require the entire item(s) be sent back to our facility for repair or restocking. Customers are responsible for the shipping costs associated with the warranty return request on all items. Parts and labor will be free only if the complete item is sent back to us for repair. The repaired/replaced/ or returned item must first have an RA number obtained by using the Contact Us for on the website. You must include your FULL NAME, ADDRESS, INVOICE NUMBER, PHONE NUMBER and EMAIL ADDRESS where we can contact you. We will then send you a RA number (return authorization). Any items returned for any reason must use our carrier only. Shipping fees for all returns are paid by the purchaser. A restocking fee of $75 will be assessed at the time of the return.

Items purchased under FINAL SALE and OPEN BOX FINAL SALE will NOT be covered by warranty or guarantee coverage.

We will not service any futons that come back to us in pieces. The warranty service allows us to either repair or offer a partial refund of 50% .

Parts provided by BigTreeUSA.com in fulfillment of its warranty obligation must be used in products for which warranty service is claimed. Any defective piece must be received back into warehouse before ANY replacement or refund will be issued. In some cases, a photograph may be accepted as proof of damage. Customers may be required to pay for special parts being requested in lieu of sending back the product for repair service, as parts and labor are only free if the item is sent back to us for servicing. 

This Warranty is expressly limited to the repair or replacement of parts and/or components and applies only under conditions of normal use. Futons are not to be used for standing upon, nor must the weight loading capacity be exceeded. Any damage to trampoline material, wood slats, or the futon frame itself due to abuse or misuse will invalidate the warranty. Some exceptions may apply. PLEASE use the contact us form to explain your situation and leave your contact information.

This Limited Warranty does not cover: 1) use of the purchaser's own fabric cover; 2) defects caused by improper assembly or dis-assembly; 3) defects occurring after purchase due to product modification, intentional damage, accident, misuse, abuse, negligence or exposure to the elements; 4) cosmetic damage, 5) labor or assembly costs, 6) damage caused by a carrier or transportation of the product from one location to another. 

The warranty included with purchase is non-transferable and will only apply to the initial purchaser. The warranty becomes void if product is resold to another party.

Except as provided herein, BigTreeUSA LLC. makes no other express or implied warranties, including without limitation any implied warranty of merchantability or fitness for a particular purpose. BigTreeUSA LLC is limited in its duty and shall have no liability or responsibility to the purchaser or any other person or entity with respect to any liability, loss or damage caused directly or indirectly by use of the product, including, but not limited to, any incidental or consequential damages. The warranty service we provide will only extend to our Contiguous U.S customers (Contiguous U.S. does not include Puerto Rico, Guam, Alaska, or Hawaii or Canada). If you have forwarded the merchandise outside the Contiguous U.S. the warranty will be void.
